You filed your income tax return on time. A few months later, an email arrives saying you have a tax demand or a mismatch. This notice is known as an intimation under Section 143(1).
Most employees who pay tax tend to panic once they receive this document. But most times the remedy is fairly simple. Sit with your Form 16, compare the figures, and take action.
This article tells you how this document came about and what to do with it.
When you file your income tax return, the Centralised Processing Centre in Bengaluru processes it automatically. No human officer reviews it. A computer system checks your return against data it already has.
This data includes TDS details reported by your employer, bank interest reported by banks, and dividend information from companies. If anything in your return does not match this data, the system flags it.
The result is an intimation under section 143(1). It is not a scrutiny notice. It is not an allegation of fraud. It is simply a computer-generated statement showing what you declared and what the system found.
If the department’s figure is higher than yours, you will see a demand. If yours is higher, you may see a refund adjustment.
Form 16 is a certificate your employer gives you after the financial year ends. It has two parts.
Part A shows the TDS deducted and deposited with the government each quarter. Part B shows your salary breakup, exemptions, deductions, and final taxable income.
Most numbers in your ITR come directly from Form 16. When there is a mismatch between your ITR and the department’s data, this is the first place to check.
Your employer should give you Form 16 every year before June 15. Most companies now send it by email as a PDF. Some upload it to their HR or payroll portal.
If you have not received it or misplaced it, here is what you can do:
The Form 26AS can be downloaded from the income tax website at incometax.gov.in by logging in using your PAN and password. It will be found in the e-filing option in the Tax Credit Statement part of Form 16A
For a Form 16 download directly from the government, only employers can do this through TRACES. As an employee, your route is through your employer or through Form 26AS.
Once you have your Form 16, match each figure against what the intimation shows. Here are the most common reasons for a difference:
Follow these steps to find and fix the mismatch:
Step 1: Open the intimation notice: The intimation arrives by email to your registered email ID. It is a PDF and usually password protected. The password is your PAN in lowercase followed by your date of birth in DDMMYYYY format.
Step 2: Identify the line item causing the mismatch: The intimation shows every head of income and deduction. Find the row where your figure and the department’s figure differ.
Step 3: Open your Form 16 and ITR: Pull out Part A and Part B of Form 16. Also open the copy of the ITR you filed.
Step 4: Verify the Figures: Verify if the figures in your ITR match those in the Form 16. Next, compare Form 16’s TDS figure with the amount that is available in Form 26AS.
Step 5: Take action accordingly: If it turns out that the Department was right and you have indeed goofed up somewhere, then submit an amended ITR or pay the demand. If the Department’s demand is unjustified, then answer to the notice online.
Log in to the income tax portal. Go to e-Proceedings or Pending Actions. Find the intimation and click on respond. You will be given options to agree, partially agree, or disagree with the demand.
If you agree, pay the tax due online. If you disagree, upload your explanation and attach Form 16 and Form 26AS as proof.
An intimation under section 143(1) is not something to ignore. But it is also not something to fear. In most cases it is a simple number mismatch that can be fixed by carefully checking your Form 16 download against what you filed.
Act within the time limit mentioned in the notice. Respond online. Keep copies of everything you submit.
